Presidential Perspectives Essay Example | Topics and Well Written Essays - 1250 words
Presidential Perspectives - Essay Example The difference between Democrats and Republics is apparent in American politics. Democrats and Republicans differ mainly in terms of philosophy, worldview, ideologies, and politics. Democrats are more of socialists and hold that the duty of the government is welfare of the people regardless of individual interests. They support government sponsored programs such as healthcare as well as subsides. Republicans, on the other hand, elevate economic equity and free market; they believe that solutions lay with the people rather than the federal government. Hence, they are more of capitalists, promoting property rights over welfare rights. They also decry active government interference in the economy. Obamaââ¬â¢s policies and Mitt Romneyââ¬â¢s are contrasting and apparent due to their political divides, which shapes their philosophy, worldview, ideologies, and politics. Alperovitz (2011) asserts that power structure in the United States can be analyzed in four rival approaches, namely: pluralism, State autonomy, elite theory, and Marxism. Pluralism theory holds that groups such as unions and professional associations, civil rights activists, business and financial lobbies govern America. Liberalists assert that there are multiple centers of power, which yield a colossal bearing in the making of laws and policies. According to Alperovitz (2011), state autonomy stresses that the government is always an autonomous force due to its control of military. Hence, they conclude that the government in the United States is the central source of power. Elite theory stipulates that leaders of large organizations inevitably dominate key sectors of the society and that America is no different. Finally, Marxism argues that property owners dominate the society. Those who hold power are predominantly those who own means of production. Policy issues such as taxes, trade agreements, and labor standoffs are a manifestation of this fact. Obamaââ¬â¢s ideologies

Social Evils Essay Example for Free
Social Evils Essay Social Evils, as the name suggests means the presence of something or some deeds existing in society which are not acceptable at all. As we know that every society or community across the seven seas has its pros and cons. Therefore, it would be incorrect to perceive that the world is picture perfect. It is a fact Universally acknowledged that no society is free or spared from the presence of Social Evils. These evils manifest themselves in so many ways that a rational human being is perplexed to discover its existence in various forms. Each society comprises of both moral and immoral people. Thereby, we can witness the contamination of the society that vanishes its goodness. It also pertains to the fact that the innocent and moral people are adversely affected as they become the target of suffering and agony. The absence of goodness and nobility in a society gives birth to Social Evils and they pave a way for themselves by overshadowing the minds of people. In the present era, the Social Evils are spreading as fast as fire. It is a renowned phrase that: A filthy fish can contaminate the entire pond. Thus, this proverb aptly suites the modern times. We cannot negate the fact that Social Evils have been present eversince Man has started to exist in groups. Man, who is ironically the higher creation has degenerated himself to such an extent that the entire surrounding in which he lives tends to have a negative impact as well. A man is judged according to his actions. Any conscious person with a sound moral sense is able to notice the vivid deterioration of his or her society. Whether we believe it or not, Social Evils are present around everybody but it is the individuals own choice either to adopt them or to reject and protest against them inorder to create a peaceful and harmonious environment in the society. Each person is nevertheless, aware of the presence of Social Evils and considers them as bad, wrong and unacceptable. Yet, they still follow them despite being conscious of their consequences. However, the question is that what causes their occurance and existence? Social Evils project chaos in the society and so their real causes must be determined.

JPMorgan Chase Essay Example for Free
JPMorgan Chase Essay JPMorgan Chase is one of the oldest and most respected banks in the United States. However, during the summer of 2012 Chase announced trading losses and bad investment decisions that resulted in a loss of approximately $5.8 billion. Not only did they report this substantial loss they admitted to falsifying their first quarter reports, were they where attempting to conceal the massive loss. Three months prior to this event JPMorgan Chase was viewed as the top American bank. The first question to be discussed in this paper will be what actions can Administrative Agencies such the Securities and Exchange Commission (SEC) and or the Commodities Futures Trading Commission (CFTC) take to prevent high risk gambles in securities/banking which are one of the main cornerstones of this countryââ¬â¢s economy. According to the SEC, their ââ¬Å"main mission is to protect investors, to maintain fair, orderly, efficient markets and facilitate capital formationâ⬠(www.sec.gov) One of the ways that SEC does this is by requiring public companies to disclose meaningful financial information to the public to help the public decide which companies will be the best to invest in. In response to the JPMorgan Chase revelation SEC Chairperson Mary Shapiro told the Senate Banking Committee that ââ¬Å"her agencyââ¬â¢s investigation is limited, because the trades happened in divisions of the banking giant that are not subject to SEC regulationâ⬠. She also stated that ââ¬Å"we (the SEC) did not have any direct oversight or knowledge of the transactionsâ⬠. In addition to the above statements Ms. Shapiro stated that ââ¬Å"the SECââ¬â¢s investigation would target the appropriateness and completeness of the entityââ¬â¢s (JPMorgan Chase) financial reporting and other public disclosure sâ⬠(Liberto, 2012). Next I will discuss the Commodity and Futures Trading Commissionââ¬â¢s (CFTC) main purpose as well as some of its other responsibilities. The Commodity and Futures Trading Commissionââ¬â¢s (CFTC)à main purpose is to regulate commodity futures and options markets. Its goals include the promotion of competitive and efficient futures markets and the protection of investors against manipulation, abusive trade practices and fraud (www.sec.gov). Gary Gensler, chairman of the CFTC told the Senate Banking Committee that ââ¬Å"he couldnââ¬â¢t provide specific information about the investigation, but he did say that he first learned about the questionable trades from press reports. He also stated that the CFTC does not have regulators on the ground to look at bank trades yet. Chairman Gensler also told the Banking Committee that currently, the American public is not protected in that way (e.g. having regulators looking at the trades as they happen) (Liberto, 2012). Regulators have been struggling for months trying to figure out who should be included in a new crackdown on swaps and derivatives. Swaps and derivatives are complex financial bets derived from other financial products. Gensler made it clear that once the Dodd-Frank Wall Street reforms are fully implemented it will be illegal for JPMorgan Chase to make the kinds of trades that resulted in the $5.8 billion loss. He also clarified that Dodd-Frank allows for trades made to hedge against ââ¬Å"individual and aggregate positionsâ⬠ââ¬â not to guard against future economic losses, as the JPMorgan trades have been described (Liberto, 2012). Next I will cover the elements of a valid contract, as well as discuss how consumers and banks each have a duty of god faith and fair dealing in the banking relationship ââ¬Å"A contract is a legally enforceable promise or set of promises. If the promise is broken, the person to whom the promise was mad ââ¬â the promise ââ¬â has certain legal rights against the person who made the promise ââ¬â the promisorâ⬠(Bagley, 2012). There are 4 basic elements to a contract and they are: 1) offer and acceptance, 2) consideration, 3) both parties must have the capacity to enter into a contract, 4) the contract must have a legal purpose. ââ¬Å"The offer is a manifestation of willingness to enter into a bargain that justifies another person in understanding that his or her assent will conclude the bargainâ⬠(Bagley, 2012). Acceptance indicates the receiving personââ¬â¢s willingness to enter into the agreement proposed in the offer (Bagley, 2012). Consideration is something of value that is provided by both parties (Bagley, 2012). Lastly, a valid contract requires that both parties have the capacity to enter into the agreement (Bagley, 2012. Next I will discuss the duty of god faith and fair dealingà in the consumer/banking relationship. Prior to 1929, Massachusetts expressly provided that good faith was applicable to all contracts. In 1929, the Supreme Judicial Court, in addressing a breach of contract claim under an option agreement for the purchase of stock in an oil-producing leasehold, expressly stated, for the first time, that there was an obligation of good faith and fair dealing in all contracts. The court emphasized that a business contract ââ¬Å"is to be interpreted as a business transaction entered into by practical men to accomplish an honest and straightforward endâ⬠. Beginning in 1936, the duty of good faith was defined as a covenant ââ¬Å"that neither party shall do anything which will have the effect of destroying or injuring the right of the other party to receive the fruits of the contractâ⬠. This ââ¬Å"fruitsâ⬠articulation of the duty of good faith remains intact today and is regularly quoted as the operative standard (Weigand, 2013). The next topic is to compare and contrast the differences between intentional and negligent tort actions. There are several types of intentional torts and they are: torts against persons, intentional torts that involve personal property, and intentional torts with regard to economic interest and business relationships. There are also several types of negligent torts. Two of which are: duty to rescue and duty to invitees. Intentional torts against consist of battery, assault, false imprisonment, intentional infliction of emotional distress, defamation, and invasion of privacy. The key word in all of these intentional torts is intent or purpose to cause harm to another. Intentional torts against property include trespass of land, nuisance, conversion, and trespass to personal property. Intent and purpose are also why these are considered intentional. The key difference between these two torts is that one is against people and the other is a misuse of anotherââ¬â¢s property. An individual has to purpose commit these acts. Negligent torts consist of different types of duties. Duty is when a person with a legal duty to another is required to act, reasonably, under the circumstances to avoid harming the other person. Some examples of this are duty to rescue and duty to invitees. Duties are basically an obligation that one person is legally bound to perform for another. In comparing the two types of torts we find that intentional torts are torts that people commit against other people. Negligence also others but it is a failure to perform that causes the injury or unjust action. Anà example of this comparison is the intentional tort of battery and failure to perform the duty to rescue. When I commit battery I cause harm to another, when I fail to perform the duty to rescue the other individual also suffers harm but it is because I failed to act. In contrast intentional torts are actions committed against another and negligence is when I fail to take action on another. Next I will discuss the tort action of ââ¬Å"interference with contractual relations and participating in a breach of fiduciary dutyâ⬠. Interference with contractual relations protects the right to enjoy the benefits of legal ly binding agreements. It provides a remedy when the defendant intentionally induces another person to breach a contract with a plaintiff. Interference with contractual relations requires intent to interfere. The existence of a contract is the difference between tortuous interference and the more difficult to prove tortuous interference with prospective contractual relations. The most famous case of tortuous interference was Pennzoil v Texaco which occurred in 1983 (Bagley, 2013). Similarly a defendant who knowingly participates in, or induces a breach of fiduciary duty by another commits the tort of participation in a breach of fiduciary duty. Lastly, I believe that if god grounds exist for the interference, such as exists in the JPMorgan Chase case then I should be able to prevail in the tort action. Lastly, I will cover how banks protect the software that allows for online transactions. Most banks protect the customers who participate in online transactions through what is called the Online Banking Guarantee. This protection covers your banking and personal information. It is the banks responsibility to ensure the customers protection while the customer engages in online transactions. In most if not all case the customer is 100% covered in the case of theft of funds. One of main defenses for software protection is through complex encryption systems. Another deterrent is simply the vast amount of software that is available for online banking. So between the wide array of software and encryption systems online banking transaction are relatively safe. In this paper I have covered several topics and they are as follows: What actions Administrative Agencyââ¬â¢s take to be effective in preventing high-risk gambles in securities and banking, the elements of a valid contract and the duty of good faith and fair dealing between banks and consumers, comparing and contrasting intentional and negligent torts, the tort action ofà ââ¬Å"Interference with contractual relations and participating in a breach of fiduciary duty, and lastly, how banks protect the software that they use for online banking. CHAPTER 3 SEGMENTATION, TARGETING AND POSITIONING 3.1SEGMENTATION The purpose for segmenting a market is to allow your marketing/sales program to focus on the subset of prospects that are most likely to purchase your offering. If done properly this will help to insure the highest return for your marketing/sales expenditures. Depending on whether you are selling your offering to individual consumers or a business, there are definite differences in what you will consider when defining market segments. At EduMentor, the kind of segmentation that is done is, segment marketing, based on a) Nature of school, i.e. public or private schools. Segmenting schools on the basis of its ownership, so that economically less privileged students of government schools can also be targeted, is unique to only EduMentor. No other player in the market, cater to the untapped potential of government school students. b) The segmentation can also be done on the basis of subjects studied at the +2 level. Like on the basis of stream: commerce, Science and humanities. Though student from any stream can apply for these entrances, but the target market becomes a little specific when considering commerce students, because often these entrances and other related courses are the first choice for them. Likewise, even within commerce students, the market can be segmented on the basis of subject mathematics, studied at the +2 level. Mathematics is essential for the entrance exam of BBE; hence, the students with commerce with maths can be motivated in that direction. 3.2TARGETING Targeting is the second stage of the SEGMENT Target POSITION (STP) process. After the market has been separated into its segments, the marketer will select a segment or series of segments and target it/them. Resources and effort will be targeted at the segment. Since BBS is a management related course it is a primary option for commerce students, so the biggest target students for the organization is students with commerce background. Humanities are going out of fashion, and the courses like Mass Communication and Hotel Management have tests on same pattern as of BBS. So, BBA training can help a student aspiring to clear a Mass Communication entrance test and also BBA entrance, like a backup option. After the primary data collection, the strategy used to reach to the prospective customers was done on the following segmentation. 3.3POSITIONING The organization has managed to form a niche for itself, in presence of strong competition from established players in the market. The positioning of the brand has been done from the very beginning, on two important propositions: The organization being the only institute for providing specialized coaching to the students who seek admission in BBS / BBA / BBE. That is the reason why the institutes faculty consists only of those who have been to the best BBA/BBS/BBE MBA institute making us ââ¬Å¾The Only Specialist BBA/BBS/BBE Entrance Coaching Instituteââ¬Å¸. At Edumentor, the core competency lies more in mentoring the students to the right path of education than merely preparing them to achieve the best results. Plus, the team, being CBSites, are more aware of the changes which have taken place in the pattern of the written test, GD and PI over the years. In fact, the core team consists of members who are involved in suggesting ways of improvement in the selection process at CBS in capacity of being Alumni of Shaheed Sukhdev College of Business Studies. Individual and State Roles in Communism According to Marx and Engels Es
Individual and State Roles in Communism According to Marx and Engels Individuals will ultimately serve the state in which the state will control many facets of the individualsââ¬â¢ life, but in return, the civilians will receive the freedoms they deserve in a communistic society. Karl Marx and Frederick Engels adamantly opposed capitalism in many ways and felt the bourgeoisie, or capitalists are enslaving the proletarians, or working class. They claimed that industrialization was reducing the common workingman into mere wage labor and believed that the proletarians of every nation needed to unite and form a revolutionary party in order to overthrow their bourgeoisie captors in order to bring about the ââ¬Å"common interests of the proletariat.â⬠1 This party will create a society in which all men are equal: a communistic society. Within the society there were roles which the individual and the state would play: the individuals would join to form a classless society in which the common interest of the citizens will rule, but the state woul d require the individuals to make sacrifices. Marx and Engels placed much of the responsibility of forming this ideal society on the individual. They called upon the working class, the proletarians, to unite and overthrow their oppressors, the bourgeoisie. In the Communist Manifesto, Marx and Engels urged the ââ¬Å"Formation of the proletariat into conquest of political power by the proletariat.â⬠1 The proletariats needed to disregard their immediate interests in order to promote the general will of the masses. The Communist Manifesto called upon all proletarians to unite in order to overthrow the bourgeoisie for the implementation of a classless society. One of the main roles of the indi... ...freedom and resources that are necessary. The party will listen to the desires and opinions of the individuals in order to keep the people in control. The idealistic society that Marx and Engels envisioned is reciprocative: individuals sacrifice many of their self- interests to the state, and in return, the state provides equality and freedom. Frederick Douglass :: biographies bio biography
Frederick Douglass (1817-1895) Frederick Douglass was born to a slave as well as a white slave owner. Aside from being born a slave, Frederick Douglass was able to teach himself how to read and write. Douglass involved himself in the improvement of the lives of other black men. Douglass was able to organize a small revolt against his owner and survived the revolt. Frederick Douglassââ¬â¢s book was published in 1845 and was named Narrative of the Life of Frederick Douglass. Douglassââ¬â¢ narrative is a recount of the tough life on the plantations before his escape to New York. Douglas describes in this narrative the senseless acts of cruelty on the part of the masters as well as the debased lives of the slaves. Frederick Douglass greatly contributed to the emancipation cause. Among Douglassââ¬â¢ several contributions was the recruitment of Negro volunteers during the Civil War period. Frederick Douglass also played a key role in safeguarding and preserving the right of his fellow freed men. Douglass later worked as a secretary of the Santo Domingo Commission, Recorder of Deeds in the District of Columbia and United States Minister to Haiti Frederick Douglas's Escape to Freedom Although Frederick Douglass did not go into great detail about his escape from his master to freedom in New York, he does describe the trying times he encountered once arriving in the free state of New York. The following excerpt is from Narrative of the Life of Frederick Douglass. "I have been frequently asked how I felt when I found myself in a free State. I have never been able to answer the question with any satisfaction to myself. It was a moment of the highest excitement I ever experiencedâ⬠¦. In writing to a dear friend, immediately after my arrival in New York, I said I felt like one who had escaped a den of hungry lions. This state of mind, however, very soon subsided; and I was again seized with a feeling of loneliness.
